Terms of Use

1. Introduction

These Terms of Use ("Terms") govern access to and use of the Fitmall Africa platform, including its mobile applications, web applications, and related services (collectively, the "Service").

Fitmall Africa provides a digital gym management solution for gyms, fitness centers, academies, and training centers to manage memberships, subscriptions, attendance, staff, and related operations.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility and Authority

The Service is intended for use by:

• Gym owners and operators
• Authorized gym administrators and staff
• Gym members whose access is granted by a gym

Accounts must be created and managed by individuals who are at least 18 years old and have the legal authority to bind the gym or organization they represent.

3. Account Registration and Responsibility

Each gym is required to designate a Gym Super Admin during onboarding.

The Gym Super Admin:

• Acts as the primary account holder
• Is responsible for all activity under the gym account
• Manages admins, staff, and members
• Is the only party authorized to request subscription cancellation or account deletion

You are responsible for maintaining the confidentiality of login credentials and for all activities conducted through your account.

4. Subscription, Billing, and Cancellation

Fitmall Africa is offered on a subscription basis.

4.1 Billing

• Subscriptions are billed in advance according to the selected plan

4.2 Cancellation

• Subscription cancellation requests must be submitted by the Gym Super Admin
• Requests must be made at least 24 hours before the current subscription period ends
• Late requests may result in automatic renewal for the next billing cycle

Cancellation stops future billing but does not automatically delete the gym account.

5. Account Deletion

Gym accounts cannot be deleted from within the application.

To request account deletion:

• The Gym Super Admin must contact Fitmall Africa's Support
• Requests must be submitted from the registered Super Admin email address
• Identity and ownership verification may be required

Account deletion is permanent and irreversible and results in loss of access to all associated data, subject to legal retention obligations.

6. Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

• Use the Service for illegal or unauthorized activities
• Interfere with or disrupt platform functionality
• Attempt to gain unauthorized access to accounts or systems
• Upload malicious code or harmful content
• Misuse member or staff data

Fitmall Africa reserves the right to suspend or terminate access for violations.

7. Member and Child Data

Gyms may use the Service to manage programs involving minors, such as children training centers.

• The Service is not intended for direct use by children
• All child-related data must be submitted by authorized adults
• Gyms are responsible for obtaining parental or guardian consent where required by law

Fitmall Africa processes such data solely for operational purposes.

8. Intellectual Property

All intellectual property rights in the Service, including software, branding, trademarks, and content, belong to Fitmall Africa or its licensors.

You are granted a limited, non-exclusive, non-transferable right to use the Service during an active subscription period.

9. Data Protection and Privacy

Use of the Service is subject to the Fitmall Africa Privacy Policy and Account & Data Deletion Policy.

By using the Service, you consent to the collection, use, and processing of data as described in those policies.

10. Service Availability and Modifications

Fitmall Africa strives to maintain reliable access but does not guarantee uninterrupted availability.

We may:

• Modify or discontinue features
• Update or change pricing with notice
• Perform maintenance or upgrades

11. Termination

Fitmall Africa may suspend or terminate access to the Service if:

• These Terms are violated
• Payment obligations are not met
• The Service is misused

Termination does not relieve you of outstanding payment obligations.

12. Limitation of Liability

To the maximum extent permitted by law:

• Fitmall Africa is not liable for indirect, incidental, or consequential damages
• Liability is limited to the amount paid for the Service during the preceding subscription period

13. Indemnification

You agree to indemnify and hold Fitmall Africa harmless from claims arising from:

• Your use of the Service
• Violation of these Terms
• Misuse of member or staff data

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws of the jurisdictions in which Fitmall Africa operates.

15. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted with a revised "Last updated" date. Continued use of the Service constitutes acceptance of the updated Terms.
